EASEMENTS - LAWYERS - FUTURE RAMIFICATIONS
Easements out to Kipling or Crosswicks seem to
have been dropped --- but might be resumed again if they fail
with the septic. Here is some info should you be
approached.
St. Michael's property goes out to Crosswicks
Road at a narrow point where their land converges with two
other properties right at the road . We believe they
thought that they had the right , therefore, to run their
pipe out to the road at this location and this apparently
appeared on a recent plan. That would, however, have
encroached upon the two adjoining properties, who, as we
understand it, have not given permission for an easement
. It seems as if this means that St. Michael's will be looking
for other properties upon which to obtain an easement .
Property owners who are approached to allow an easement should
consider that it might be advisable to obtain a lawyer.
The agreement would be between the property owner and St
Michael's and could involve, besides landscaping issues, a
detriment to the value of the home, as use of the area with the
easement might be limited . In addition, there is some
concern that the easement might, if the contract does not
properly specify, allow St Michael's church-goers to park
back on the residential streets ( as they often do now ) and to
use the property with the easement for access. This would
affect all of the neighbors as the Sunday parking might be in
front of their houses. This could be avoided, most
likely with a properly worded agreement .
In addition, another concern that was brought up
was the possibility that at some point in the future an
"Emergency Vehicle" route or alternative exit route might be
sought due to the numbers of guests at the facility, and the
easement area might
make a convenient access. There are a variety of reasons
for which a township can take property by eminent domain.
It might be best to have a lawyer respond to some of these ideas
before granting an easement without being fully advised.
